Agreement to Terms

By downloading, installing, or using any TinyTrail application ("App") or visiting our website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Apps or website.

These Terms apply to all users of our Apps and website, including without limitation users who are browsers, customers, merchants, and/or contributors of content.

Use License

Subject to your compliance with these Terms, TinyTrail grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install our Apps on your personal device(s)
• Use our Apps for personal, non-commercial purposes
• Access our website for informational purposes

You may not:

• Modify, decompile, reverse engineer, or disassemble our Apps
• Copy, redistribute, or sell our Apps or any part thereof
• Remove any proprietary notices or labels from our Apps
• Use our Apps for any commercial purpose without prior written consent
• Use our Apps in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to our systems or networks

Purchases and Payments

Paid Apps and In-App Purchases

Some of our Apps are paid or contain in-app purchases. All purchases are processed through Apple's App Store or Google Play Store, and are subject to their respective terms and conditions.

Pricing

Prices for our Apps and in-app purchases are subject to change without notice. All prices are in the local currency of your App Store region.

Refunds

Refund requests are handled by Apple or Google, not by TinyTrail directly. Please contact the respective app store for refund requests.

User Content

Some of our Apps allow you to create, store, or share content ("User Content"). You retain ownership of your User Content and are solely responsible for it.

By creating User Content within our Apps, you grant TinyTrail a non-exclusive, royalty-free license to use, display, and process such content solely for the purpose of providing and improving our Apps.

You agree not to create User Content that:

• Is unlawful, harmful, threatening, abusive, or defamatory
• Infringes on any third party's intellectual property rights
• Contains viruses or malicious code
• Violates the privacy of others

Intellectual Property

Our Apps, website, and all content therein, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the property of TinyTrail or its licensors and are protected by copyright, trademark, and other intellectual property laws.

The TinyTrail name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of TinyTrail. You may not use such marks without our prior written permission.

Disclaimer of Warranties

OUR APPS AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• Our Apps will be uninterrupted, timely, secure, or error-free
• The results obtained from using our Apps will be accurate or reliable
• Any defects in our Apps will be corrected

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TINYTRAIL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL TINYTRAIL'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR APPS EXCEED THE AMOUNT PAID BY YOU TO TINYTRAIL FOR THE APPLICABLE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless TinyTrail and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of our Apps, your violation of these Terms, or your violation of any rights of another.

Termination

We may terminate or suspend your access to our Apps immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use our Apps will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive termination.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any material changes by updating the "Last updated" date at the top of these Terms.

Your continued use of our Apps after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, please stop using our Apps.
